Sexual Offences (Procedure and Evidence) (Scotland) Bill: Stage 2
In commenting on amendment 20, in the name of Bill Aitken, I shall focus particularly on proposed subsection (4A), paragraph (c), to which the minister referred. It says that the conditions are:"that there are reasonable grounds to believe that the quality of evidence … is likely to be diminished if the cross-examination is conducted by the accused in person and likely to be improved if an order is made".That cuts right across the grain of the intention of the bill, and gives paramouncy to the quality of evidence over the protection of a vulnerable witness. On those grounds alone, I do not believe that we can agree to amendment 20.
