Tied Pubs (Scotland) Bill: Stage 2
As has been discussed, the Parliament agreed to the general principles of the bill at stage 1. I believe that our job today is to make sure that it is fit for purpose for both sides. It is important that publicans who have tied leases feel that they are being fairly treated and that they have all the necessary protections in the bill. However, it is also important that the pubcos—those who own the buildings—can get a fair return on them. If the bill does not result in a win-win situation for both sides, there will be a decline in the opportunity for people who wish to become publicans to enter the market. Tied pubs are often the first stage in that process. Through my amendments, I am keen to ensure that such a win-win situation exists. My amendments in this group—amendments 18, 24 and 29—are quite simple. They aim to ensure that there is fairness for both sides. Amendment 18 would allow information to be provided electronically or in hard copy. With amendment 24, I want to make sure that any methodology accords with industry practice, otherwise there will end up being conflicts between the bill and the realities of commercial practice. I also want to ensure that there is balance in respect of the difference in the size and resources of the parties and a recognition that tied publicans probably do not have huge resources, so that they can fight on an equal footing if there are any disputes. My amendments are quite simple, and I hope that the committee will see fit to agree to them. I move amendment 18.
