Islands (Scotland) Bill: Stage 2
I agree with John Mason’s point that a purpose clause should be introduced at as early a stage as possible. I had no control over the wording of the draft bill. This is the earliest stage at which I, as a committee member, can introduce such a clause, which is why I have lodged amendment 28. Mike Rumbles made a very good point when he said that we could agree to the amendment today, and if members are unhappy with the specific wording of the purpose clause, it can be amended at stage 3. I do not fully accept the argument that a carefully worded purpose clause cannot complement the rest of the bill; it certainly would not undermine it—it is all in the wording. I am aware that members might have a sense of déjà vu. I was not on the committee at the time, but we had a similar debate on the Forestry and Land Management (Scotland) Bill, during which a purpose clause was suggested and members expressed concern about the specific wording with a view to amending it at a later stage. I am tempted to go down that route again and not to press my amendment on the basis that members can come together to agree the wording of a purpose clause that could be inserted through an amendment at stage 3. I will not press my amendment at this point, but I emphasise that I hope that we can work on the wording for an amendment to be lodged at stage 3. Amendment 28, by agreement, withdrawn.
