Criminal Justice (Scotland) Bill: Stage 1
The extent of that injustice is clear. Research for the Carloway review identified that, in 2010, 268 serious cases were dropped after the initial court appearance—cases in which there would have been a reasonable prospect of successful prosecution. The Lord Advocate has said that there were 170 rape allegations in the past two years where no proceedings were taken because of insufficient evidence. Crown Office research from last year suggested that around 60 per cent of domestic abuse cases—2,210 cases—could have progressed under the new prosecutorial test.
